Avinx Solutions LLC ("AVINX", "we", "us", "our") respects your privacy. This Privacy Policy explains what personal information we collect through this website, why we collect it, who we share it with, how long we keep it, and the rights you have over it.

This website is aimed at professional audiences in Europe and North America. Depending on where you live, the European General Data Protection Regulation (GDPR) or United States state privacy laws such as the California Consumer Privacy Act (CCPA, as amended by the CPRA) may give you specific rights. Both are covered below.

Avinx Solutions LLC has not appointed a Data Protection Officer (“DPO”). Privacy-related enquiries and requests may be submitted directly using the contact details above.

 

2. What personal information we collect

2.1 Information you give us through the contact form

Our contact form collects five pieces of information about you.

Three of them are required, because we cannot answer you without them: your name, which we use to address you personally in our reply; your work email address, which is where we send that reply; and your message in the "How can we help?" field, which tells us what your enquiry is about.

Two are optional, and you are free to leave them blank: your company, which helps us understand the organisational context of your enquiry, and your area of interest, which helps us route your enquiry to the right person.

Please do not include confidential, classified or particularly sensitive information in the free-text field. A web form is not an appropriate channel for it. If your enquiry concerns a sensitive matter, simply say so and we will agree a secure channel with you.

 

2.2 Information collected automatically

When you browse the website, our hosting provider records technical data for security, stability and audience-measurement purposes: IP address, browser type and version, operating system, device type, pages visited, date and time of visit, and the page that referred you. This is described further in section 8.

 

2.3 Information we do not collect

This website has no user-account system, processes no payments, and does not knowingly collect special categories of data as defined by Article 9 GDPR (such as health data, political opinions, religious beliefs or biometric data). We do not buy personal data from data brokers.

3. Why we use your information, and on what legal basis

We process your personal information for five purposes, each with its own legal basis under Article 6 of the GDPR.

To reply to your enquiry and, where relevant, prepare a proposal. This uses the information you entered in the contact form. The legal basis is the taking of steps at your request prior to entering into a contract, Article 6(1)(b), together with our legitimate interest in responding to business enquiries, Article 6(1)(f).

To manage the business relationship that may follow. This also uses your contact-form information. The legal basis is the performance of a contract, Article 6(1)(b), or our legitimate interest, Article 6(1)(f).

To keep the website secure, available and free from abuse. This uses technical data and the essential cookies described in section 8. The legal basis is our legitimate interest in protecting our systems, Article 6(1)(f).

To measure how the website is used, in aggregate, so that we can improve it. This uses audience-measurement data. The legal basis is your consent where consent is required, Article 6(1)(a), and otherwise our legitimate interest, Article 6(1)(f).

To comply with our legal and accounting obligations. This uses contact and contract data. The legal basis is compliance with a legal obligation, Article 6(1)(c).

We do not use your information for automated decision-making or profiling that produces legal effects concerning you.

 

4. Who has access to your information

We do not sell your personal information, and we do not rent or trade it.

Your information may be accessed by:

  • Our staff and authorised consultants, on a need-to-know basis, in order to answer your enquiry;

  • Wix.com Ltd., our website host, which operates the site infrastructure, the contact form and the storage of form submissions on our behalf, as a processor acting on our instructions. Wix's own privacy practices are described at https://www.wix.com/about/privacy;

  • Microsoft 365, which hosts our professional mailboxes and therefore your message once it reaches us;

  • Our professional advisers — lawyers, accountants, auditors — where necessary and under a duty of confidentiality;

  • Public authorities or courts, where we are legally required to disclose information.

Each of our processors is bound by a written agreement requiring them to process personal data only on our instructions and to apply appropriate security measures.

 

5. International transfers

Because Avinx Solutions LLC is incorporated in the United States and some of its service providers operate internationally, personal information may be processed outside the country in which the website visitor is located.

Where the GDPR applies and personal information is transferred outside the European Economic Area, appropriate safeguards will be used where required by law, including an applicable adequacy decision or approved contractual safeguards such as the European Commission's Standard Contractual Clauses.

6. How long we keep your information

We retain personal information only for as long as reasonably necessary for the purpose for which it was collected and to meet applicable legal, contractual and regulatory requirements.

Business enquiries that do not result in a client relationship: generally up to three years from the last meaningful contact, unless a shorter or longer period is appropriate in the circumstances or required by law.

Information relating to clients, suppliers or contractual relationships: retained for the duration of the relationship and thereafter for the period required or permitted under applicable legal, accounting, tax or limitation requirements.

Technical and cookie information: retained for periods appropriate to the relevant technology and purpose, as described through the website's cookie-management tools where applicable.

 

7. How we protect your information

We apply technical and organisational measures appropriate to the risk, including encryption of the website in transit (HTTPS/TLS), access controls limiting who can read form submissions, hosting on infrastructure certified to recognised security standards, and internal confidentiality obligations for everyone who handles enquiries.

No transmission over the internet can be guaranteed to be completely secure. This is why section 2.1 asks you not to send sensitive information through the contact form.

 

8. Your privacy rights

Where the GDPR or equivalent applicable data-protection legislation applies, you may have rights including::

  • Access — obtain confirmation of whether we process your personal data, and receive a copy of it;

  • Rectification — have inaccurate or incomplete data corrected;

  • Erasure — have your data deleted, where one of the grounds in Article 17 applies;

  • Restriction — ask us to suspend the processing of your data in certain circumstances;

  • Portability — receive the data you provided to us in a structured, commonly used, machine-readable format, and have it transmitted to another controller;

  • Objection — object at any time, on grounds relating to your particular situation, to processing based on our legitimate interest; and object at any time, without giving a reason, to processing for direct marketing purposes;

  • Withdrawal of consent — where processing is based on your consent, withdraw it at any time, without affecting the lawfulness of processing carried out beforehand;

  • Post-mortem instructions — give directions on what should happen to your data after your death, in accordance with Article 85 of the French Loi Informatique et Libertés.

How to exercise your rights. Write to info@avinxsolutions.com. Please say which right you wish to exercise. We reply within one month of receiving your request; for complex requests this may be extended by two further months, in which case we will tell you within the first month. We may ask for proof of identity if we have reasonable doubt about who is making the request.

Complaints. If you consider that we have not respected your rights, you may lodge a complaint with the French supervisory authority:

9. Children

This website is intended for professional audiences and is not directed at children. We do not knowingly collect personal information from anyone under 16. If you believe a child has provided us with personal information, contact us at info@avinxsolutions.com and we will delete it.

 

10. Cookies and similar technologies

This website may use cookies and similar technologies necessary for its operation and security.

Where non-essential cookies or similar technologies are used — including analytics or other technologies requiring consent under applicable law — they will not be activated until the required consent has been obtained.

Visitors will be provided, where required, with the ability to accept, refuse and subsequently modify their cookie preferences.

Further information about cookies used on the website, their purposes and applicable retention periods will be available through the website's cookie-management interface.

 

11. Changes to this policy

We may update this Privacy Policy to reflect changes in our practices or in the law. The version in force is always the one published on this page, and the date at the top shows when it was last revised. If we make a material change, we will signal it clearly on the website and, where we hold your email address and the law requires it, notify you directly.
